1. Agreement to Terms

By accessing or using the SOAR Canada website at soarcanada.ca (the “Site”) or by contacting us or engaging with our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site or our services. SOAR Canada (“SOAR,” “we,” “us,” or “our”) operates as Snowy Owl Acute Radiology and provides after-hours acute teleradiology and related services in Canada.

2. Use of the Website

The Site is provided for informational purposes and to facilitate contact with SOAR for partnership, coverage, credentialing, and related inquiries. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site to transmit any harmful, offensive, or unlawful content; to attempt to gain unauthorized access to any systems or data; or to interfere with the Site’s operation. We reserve the right to suspend or restrict access to the Site at any time.

3. No Medical Advice

The content on the Site is for general information only and does not constitute medical, diagnostic, or clinical advice. Patient care and imaging interpretation are provided only through formal agreements with hospitals and healthcare facilities. Nothing on the Site creates a physician–patient relationship or replaces consultation with a qualified healthcare provider.

4. Services and Contracts

Teleradiology, emergency coverage, and other professional services are provided pursuant to separate agreements with hospitals, clinics, or other entities. The specific terms, scope, and obligations of those services are governed by those agreements and applicable professional and regulatory standards, not solely by these Terms.

5. Intellectual Property

The Site and its content (including text, graphics, logos, and design) are owned by SOAR Canada or its licensors and are protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our prior written consent, except for limited personal or non-commercial use such as viewing or sharing links.

6. Privacy

Your use of the Site and any information you submit (for example via our contact form) are also governed by our Privacy Policy. By using the Site, you consent to the collection and use of information as described in that policy.

7. Disclaimers

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Your use of the Site is at your sole risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SOAR Canada and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising from or related to your use of the Site or these Terms. Our total liability for any claims arising from your use of the Site shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless SOAR Canada and its affiliates and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Ontario.

11. Changes

We may update these Terms from time to time. The “Last updated” date at the top of this page will be revised when changes are made. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
